Duties of a Guardian Ad Litem

He or she will make recommendations to the judge based on the findings of the investigation.
During their investigation, a guardian ad litem may speak to both parents, and they may interview the children either with or without the parents being present. They may also visit the parents' homes to determine whether they have the necessary space to accommodate children and whether they can provide a safe and healthy environment. If necessary, they may also speak to others who can provide information about children's best interests, such as doctors, therapists, teachers, or extended family members.
The guardian ad litem is not an advocate or attorney for either parent. His or her sole responsibility is to protect the best interests of the child. While a judge is not required to follow the recommendations of a guardian ad litem, the findings of an investigation will often play a significant role in decisions about the allocation of parental responsibilities and parenting time. How to Prepare for a Guardian Ad Litem Interview in DuPage County
Preparing for a GAL interview starts with being honest and consistent, since inconsistencies between what you say and what other evidence shows can undermine your credibility.
Keep your home clean and organized before any scheduled visit, and be ready to discuss your daily routine with your child, including school, activities, and how you handle discipline. Avoid bad-mouthing the other parent during the interview, as this behavior could be interpreted as a sign of poor cooperation rather than a legitimate concern. Have relevant documents on hand, such as school records or medical information, in case the GAL requests them.
Can a Parent Request a GAL in a Divorce?
Either parent can ask the court to appoint a GAL. Still, this should not be interpreted as a GAL "working" for one parent, as the GAL always puts the child's best interests first. The court can also appoint a GAL on its own, without a request from either parent, when the circumstances of the case warrant an independent investigation.
